Privacy Policy

Information shared by the user on the SLR platform such as name, phone number, emergency contact number, gender, occupation, hometown, personal interests, email address, medical history and any other information shared with a SLR Professional shall be deemed to be "Personal Information" under the T&C. SLR collects this Personal Information to provide a smooth, efficient and customised experience to the user. The collection of Personal Information also enables the user to create an account and profile that is used to interact with the SLR Professional.

SLR is dedicated to maintaining the privacy and integrity of the Personal Information of the user at all times. Personal information shared by the user on the SLR platform will be used for:

• Identify and reach the user;
• Resolve service and billing problems;
• Assist in scheduling appointments, send reminder for upcoming or follow-up appointments, and intimate about cancelled appointments;
• Provide the user with further information related to products and services available on the SLR platform;
• Better understand the users' needs and interests;
• Run statistical research (such research will only use the information in an anonymous way and cannot be linked back to the user);
• Make disclosures as may be required under applicable law
• Improve the website or mobile application in order to better serve the user;
• Run a contest, promotion, survey on the SLR platform;
• Process any financial transaction in a timely manner.

By using the SLR platform, providing Personal Information or making a payment on the SLR platform, the user consents to the collection, storage, processing, disclosure and transfer of Personal Information in accordance with the provisions of this privacy policy and under the data privacy laws in India. If the user does not provide with the relevant Personal Information or at point in time withdraws the consent to make such Personal Information accessible to the SLR Professional, the SLR platform is not obligated to fulfil the purpose for which the said Personal Information was sought.

The SLR Professional will take all reasonable precautions to protect the confidential information obtained directly through the user or stored in any medium on the SLR platform. Given SLR's aim of delivering high-quality services, all professionals working with the platform are required to be part of a regular supervision structure where all cases are discussed.

If there is a threat to the well-being of the client themselves or to someone else (cases involving harm to self or others), the SLR Professional will be obligated to share information with the clinical supervisor and others, including emergency contacts, and other people deemed fit and essential to maintain safety, including but not limited to family, friends and law enforcement authorities, or to comply with legal requirements.

In the event the user is required to or chooses to seek a consultation from another mental health or medical professional, clinically significant information can be shared with the relevant professional with the consent of the user.

Except for the reasons outlined above, any information shared on the SLR platform will only be shared with others with prior permission of the user.

SLR reserves the right to add, change, or remove sections from the Privacy Policy without notice or liability to any third-party.

Limitation of Liability

SLR does not guarantee registration any person as a user or as a client on the SLR website and reserves its right to terminate the registration at any time without citing a reason.

The service on the SLR platform is dependent on the information provided by the user to the SLR Professional and SLR does not promise any particular outcome to the user based on counselling and therapy. SLR also does not guarantee the availability of the same professional over any period of time.

Counselling will take place at a frequency of one session every week or such other frequency agreed to between the user and the SLR Professional. SLR and its professionals cannot guarantee that sessions will always take place on the same day of the week but will make every effort to meet the requirements of the user.

SLR and its professionals reserve the right to determine that offline and online counselling services are not appropriate for a particular user and decide in their sole discretion that additional help is needed for the user and shall choose to bring in an additional professional.

All SLR Professionals have a contractual relationship with SLR and are allowed to use our platform and technology to provide services to the user. SLR does not assume any responsibility for their actions, advice or any other information provided through the SLR platform or otherwise. SLR shall not be held liable for any damage/ loss/ liability caused to the user by the SLR Professional, either directly or indirectly. The user is responsible for all their decisions and actions and agrees that they are made independent of any representations by SLR or its professionals. SLR and/or its professionals cannot be held responsible for such decisions and actions or any outcomes as a result.

SLR provides a profile page on its website where information regarding education, training, experience, specialities of the SLR Professionals is provided to the user. While SLR makes all efforts to verify the credentials of every professional on its platform, it is not responsible for any misrepresentation/fraudulent credentials or claims by the professional and such responsibility lies with the SLR Professional.

SLR does not endorse or influence any particular branch of medicine, theory, opinion, viewpoint or position on any topic whether expressed and/ or implied, in oral and/ or written communication from a SLR Professional. All content, products and services, provided on the SLR platform is for general information only and should not be relied upon or used as the sole basis for making decisions. SLR shall not be held responsible if any information on its platform or that provided by the SLR Professional is inaccurate, incomplete or not current.

Any material downloaded or otherwise obtained on the SLR platform and / or any products or services accessed on the SLR platform is at the risk of the user, and the user will be solely responsible for any damage or loss of data to the computer system of the user that results from such download or use of product or service on the SLR website.

At SLR, we believe it is unethical for the SLR Professionals to have an individual relationship with current or former clients including any association on social network websites such as Facebook, Twitter, Instagram etc.

The user hereby agrees to indemnify, defend, and hold SLR, and its directors, owners, employees, agents, and representatives, harmless from and against any and all losses, damages, liabilities and costs arising from the use of the SLR platform.

Disclaimer

Any interaction and its related outcome on the SLR platform is strictly between the SLR Professional and the client and SLR shall not be held responsible for the same. The user agrees that any engagement with a professional on the SLR platform is done so at their own discretion. SLR makes no representations concerning, and does not guarantee, the accuracy of any services, including, but not limited to, any information provided through the services on the SLR platform or their applicability to the individual circumstances of the user.

SLR may provide the user with access to third-party tools as it deems fit which the SLR platform neither monitors nor has any control or input over. SLR is not responsible for examining or evaluating the accuracy of such tools. Any use by the user of such optional tools offered through the SLR platform is entirely at the discretion of the user.

Entire Agreement

The T&C and any policies posted by SLR on this platform constitutes the entire agreement and understanding between the user and SLR and it will govern the use of all services provided by the SLR platform, superseding any prior agreements, communications and proposals, whether oral or written, between the user and SLR.

The failure on the part of SLR to exercise or enforce any right or provision of this T&C shall not constitute a waiver of such right or provision.

Termination

The T&C is effective unless and until terminated by either parties. The obligations and liabilities of the user and SLR incurred prior to termination date shall survive the termination of these T&C for all purposes.

The user may terminate the T&C at any time by notifying the SLR platform, subject to settlement of all outstanding payments. SLR may in its sole judgement decide that the user has failed to comply with any term or provision of the T&C, and subsequently terminate the T&C at any time without notice and the user will remain liable for all amounts due up to and including the date of termination.

Errors, Inaccuracies and Omissions

SLR reserves its right to correct any typographical error, inaccuracy or omission on the SLR platform that may relate to a product, service description, pricing, promotions or offers at any time without prior notice

Indemnification

The user agrees to indemnify, defend and hold SLR and its subsidiaries, affiliates, partners, officers, directors, professionals, employees and interns, harmless against any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of the breach of the T&C.

Severability

In the event any provision of the T&C is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from the T&C. This shall not affect the validity and enforceability of the other provisions under the T&C.

Grievance Redressal

If the user is dissatisfied with any aspect of the service on the SLR platform, to address the grievances of the users, he/she may contact us at support@thelisteninroom.com. SLR is committed to providing a time bound solution not exceeding one month from the date of such complaint.

Jurisdiction

Jurisdictional policies of SLR have been drafted in accordance and compliance with Indian laws. Any and all disputes arising between the user and SLR with regards to the T&C, including its interpretation shall be subject to the exclusive jurisdiction of the courts at Mumbai, India.
